Your privacy is important to Everae LLC (“Everae”). We abide by privacy standards to ensure personal information we collect, use and share is protected. This Online Privacy Policy (“Policy”) applies to users located in the United States of America (“U.S.”) describes how Everae and our affiliates manage personal information about you when you utilize the Everae website and any Everae services (collectively the “Applications”). The term “Everae” or “we”, “us” or “our” in this Policy refers to Everae and its affiliates.

 

  1. PURPOSE
    • This Policy explains the following information: (a) How Everae collects personal information when you use the Applications; and (b) How Everae may use or share personal information collected to deliver products and services to you and for advertising.
    • By using the Application, you agree to the terms and conditions of this Policy, as well as Everae’s Terms of Use. The Application and this Policy are intended for a U.S. audience. The Application is not currently intended for use by an international audience. If this changes, Everae will update its Privacy Policy and provide notice of such changes.
    • Everae works with third-party providers who are contractually obligated to comply with our policies to protect information. However, if you visit or access one of these third-party provider websites or other service offerings (which are separate from Everae), please review the online privacy practices of that site or mobile app to understand the specifics of how your online personal information may be collected, used and shared.

 

  1. UPDATES
    • This Policy is subject to change. We update this Policy periodically to comply with the most recent federal and local laws. Please review it whenever you have questions. If we make changes to this Policy, we will revise the last updated date on this page.
    • We are committed to transparency about your personal information. By using the Applications, you consent to the collection, use and sharing of your personal information subject to and consistent with applicable laws, regulations and other Policies you may have received based on your relationship with us.

 

  1. THIRD-PARTY WEBSITES AND ONLINE SERVICES
    • We may provide links to non-affiliated third-party sites, such as service providers or merchants. If you follow links to sites not affiliated with, or controlled by Everae, you should review their privacy and security policies and other terms and conditions, as they may be different from those published by Everae. Everae does not guarantee and is not responsible for the privacy or security of any third-party, including the accuracy, completeness or reliability of their information.

 

  1. GENERAL INFORMATION
    • To protect personal information from unauthorized access and use, we use security measures that comply with applicable federal and state laws. These measures may include device safeguards and secured files as well as oversight of our third-party providers to ensure personal information remains confidential and secure. In the event of a data breach, we provide timely notification, in accordance with applicable laws and regulations.
    • We recognize the importance of protecting privacy where children are involved. Our Applications are not marketed to individuals under the age of 13. Accounts that include online access for children under the age of 13 are owned by a parent or guardian and require specific consent for online access. We do not knowingly collect personal information from children under 13 for any purpose.
    • Keeping your personal information accurate and up to date is very important. If your personal information is incomplete, inaccurate or not current, please contact us to make the requisite corrections.

                         

  1. PERSONAL INFORMATION WE COLLECT ONLINE
    • Collection Methods. We collect personal information about you through your computer or mobile devices by the use of cookies as well as personal information you provide when you use the Applications, for example when you:
      • When you voluntarily submit information to us online.
      • Request information from Everae regarding its services.
      • Register as a participant in one of our events.
    • Additional Sources. Additional categories of sources from which we collected Personal Information are:
  • Service Providers, Other Everae Customers, Credit Reporting Agencies and other similar persons or entities.
  • Public Record Sources (Federal, State or Local Government Sources).
  • Information from our Affiliates.
    • We may use third-party providers to process personal information for business purposes on our behalf. Third-party providers are contractually obligated to comply with our policies to protect information we share with them or they collect on our behalf.
    • We also may obtain personal information about you from other end users of the Applications. However, the personal information we collect is limited to what is required to provide our services and to support legal and risk requirements.
    • The type of personal information we collect from and about you online will depend on how you interact with us, and may include the following:
      • Contact information such as name, age, gender, mailing address, email address, telephone, and mobile number(s).
      • Commercial information, such as records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.
      • Geolocation data, such as device location and Internet Protocol (IP) location.
      • Professional or employment-related information.
      • Inferences drawn from any of the Personal Information listed above.
      • Documents or images submitted to and/or through the Applications.
      • Information from your computer and mobile devices where allowed by individual browsers and/or operating systems, internet, or other electronic network activity information, such as:
        • Browser type, version, language, and display/screen settings.
        • Information about how you use and interact with our Application (for example, unique and measurable patterns such as keystrokes, mouse clicks, and movements).
      • Communications data, such as your communication preferences and details or the content of your communications with us (e.g., text messages, chat messages).
        • Information Everae does NOT Collect. There are categories of information that neither Everae nor the Application will seek to collect. If any of the following categories of information are requested by any organization or individual purporting to be Everae or Application, please contact Everae immediately, such requests for such information may be a sign of fraud:
      • Biometric information and the processing of biometric information.
      • Medical Information.
      • Race, ethnicity, citizenship, or immigration status.
      • Religious affiliation or philosophical beliefs, or union membership.
      • The contents of your mail, email, and text messages unless Everae is the intended recipient of such communications.

 

  1. HOW PERSONAL INFORMATION IS USED AND SHARED
    • Data Collection. Personal information collected from and about you online described in this Policy may be used for many purposes such as:
  • Delivering products and services to you by verifying your identity (for example when you access your account information).
  • Providing customer service/production support.
  • Providing advertising on our Applications as well as non-affiliated third-party sites through Google Ads.
  • Performing analytics concerning your use of our Applications, including your responses to our emails and the pages you view.
  • Complying with and enforcing applicable legal requirements, industry standards, contractual obligations and our policies.
  • Undertaking internal research for technology development and demonstration.
    • Data Retention. The length of time that we intend to retain each category of Personal Information will depend on several criteria, including (i) the length of time we are required to retain Personal Information in order to comply with applicable legal and regulatory requirements; (ii) the length of time we may need to retain Personal Information in order to accomplish the business or commercial purpose(s) for which such Personal Information is collected, used or disclosed (as indicated in this Notice); and (iii) whether you choose to exercise your right, subject to certain exceptions, to request deletion of your Personal Information.
    • Data Deletion. We securely delete personal information as soon as legally permitted, using commercially reasonable means.
    • Data Sharing. We may share the personal information we collect from and about you online described in this Policy (and subject to other legal restrictions and Policy(ies) you may have received depending on your relationship with us) with: affiliates and subsidiaries of Everae; third-party providers who have contracts with Everae; and Government agencies, but only as required by laws and regulations.
    • Aggregation of Data. Collected personal information may be aggregated and/or de-identified (we remove any details that identify you personally). We may share this aggregated and/or de-identified information with third-party providers to help deliver products, services, and content that are better tailored to the users of the Applications and for our own business purposes where permissible under applicable laws and regulations.
    • Limited Sharing. You have choices regarding the sharing of some personal information. Where appropriate, we will limit sharing of your personal information based on your marketing and information sharing choices. You can communicate your choices by emailing privacy@everaeco.com
    • Data Sale. Everae does not sell your personal information.
    • Your Rights. You have the right to receive this Policy at or before the point of collection of your Personal Information. Additionally, you have the following rights regarding any Personal Information that we collected from you within 12 months preceding your request to exercise these rights, free of charge:
  • Learn the categories of Personal Information about you that we collected.
  • Learn the categories of sources from which the Personal Information was collected.
  • Learn the purpose for collecting Personal Information about you.
  • Learn the categories of third parties to whom we disclosed Personal Information about you and the categories of Personal Information that were disclosed (if applicable) and the purpose for disclosing the Personal Information about you.
  • Learn the specific pieces of Personal Information we collected about you.
  • Request we correct inaccurate Personal Information that we maintain about you.
  • Request we delete Personal Information we collected from you, absent any legally acceptable exceptions.
  • Be free from unlawful discrimination for exercising your rights herein.
    • Please note that requests for specific pieces of Personal Information will require additional information to verify your identity. For individuals submitting a request on behalf of another person, we may require proof of authorization and verification of identity directly from the person for whom the request is made. For a company or organization submitting a request on behalf of another person, we may require proof of authorization from the individual such as a power of attorney and verification of identity directly from the person for whom the request is made.
    • In some instances, we may not be able to honor your request. For example, we will not honor your request if we cannot verify your identity or if we cannot verify that you have the authority to make a request on behalf of another individual. Additionally, we will not honor your request where an exception applies, such as where the disclosure of Personal Information would adversely affect the rights and freedoms of another person. We will advise you in our response if we are not able to honor your request.
    • We will work to process all verified requests within 45 days. If we need an extension for up to an additional 45 days in order to process your request, we will provide you with an explanation for the delay.
  • Exercising Your Rights. You may exercise your rights in the preceding section by emailing us at privacy@everaeco.com.
  • Questions Regarding Your Rights. Any questions regarding your rights or this Policy should be directed to the contact information in the foregoing section.

 

  1. ADVERTISING
    • Currently, Everae only utilizes temporary, session cookies, which are necessary for the Application to function. A session starts when you open the Application and ends when you close Application. Session cookies contain information that is stored in a temporary memory location by Everae, but it is deleted after you close the application or browser window.
    • Google Ads. Everae utilizes conversion tracking services with Google Ads. Conversion tracking is a free tool that shows a website what happens after a customer interacts with its ads, such as whether the customer signed up for a newsletter or called the business. When a customer completes an action that Everae defines as valuable, these customer actions are called conversions that Everae learns from in attracting Application interest and tracking.   • Tailored Ads. Additionally, Everae may use personal information about your activities on the Applications, such as key words entered, to help determine which of our ads or offers may be of interest to you. We may also use personal information about your relationship with us to help determine which advertisements or offers to present to you.
  • Third-Party Ads. Please note that once you leave Everae’s Applications, Everae has no control over how any third-party uses your personal information or response to their advertisements. You would need to visit the individual advertiser’s website for more information.
  • Opting-Out of Advertisements on Non-Affiliated thirty-party websites: To learn more about ad choices, or to opt out of interest-based advertising with non-affiliated third-party sites, please consider the following: (a) visit “Your Ad Choices” powered by the Digital Advertising Alliance or through the Network Advertising Initiative’s Opt-Out Tool through your preferred internet search engine; (b) Disable third-party cookies through your internet browser’s settings; and/or (c) You may also visit the individual sites for additional information on their data and privacy practices and opt-out options. Please note: If you delete cookies, buy a new device, access our Sites and Mobile Apps or other sites from a different device, login under a different screen name, or change web browsers, you will need to opt out again.
    • Please note that if you opt out of this advertising, you may still receive some general advertisements from Everae when utilizing the Application and/or tailored content based on your account settings.

 

  1. MISCELLANEOUS INFORMATION
    • Social Media. Everae may engage with you on social media platforms such as Facebook®, X®, YouTube® and LinkedIn®. Any content that you post on social media platforms, such as pictures, information, opinions, or other personal information, which you make available to other participants on these platforms is subject to the Terms of Use and Privacy Policies of those respective platforms. Please review those Terms and Use and Privacy Policies, as Everae has no control over them.
      • We may allow social share buttons on our sites that enable users to easily share information on social media platforms. The non-affiliated third parties that own these widgets may have access to information about your internet browsing where these widgets are placed.
